Who is the controller?
Your data is processed in each case by the BYD company advertising the position you applied for, as identified in Appendix 1.
What data may we process?
- identification and contact data;
- CV and professional profile data;
- interview and evaluation data;
- correspondence; and
- certain health-related or other special category data provided by you (e.g. reduced working capacity), but only if you voluntarily provide such data to us and the lawful conditions for the processing are met.
For what purposes may we process your data?
a) Recruitment data processing: receiving, registering and assessing your application, evaluating your suitability for the position, managing and documenting the recruitment process, communicating with you, and, where applicable, considering you for another open position.
b) Group-level HR administration: group-level HR administration and recruitment support.
On what legal basis may we process your data?
a) The legal basis for recruitment data processing is your consent.
Providing your personal data is voluntary. However, if you do not provide the personal data necessary for the recruitment process, BYD may be unable to consider your application or continue the recruitment process.
b) Intra-group data transfers within the BYD group for group-level HR administration or recruitment support purposes are based on BYD’s legitimate interests.
Who may access your data?
Your data may be accessed on a need-to-know basis by HR personnel, hiring managers, interviewers, relevant internal stakeholders, BYD group companies, and Teamtailor and other service providers.
In the case of data transfers outside the EEA or the United Kingdom, BYD applies appropriate safeguards.
How long may we retain your data?
- If you are hired, recruitment data may become part of your employee records, which will be processed under separate data protection rules.
- If your application is unsuccessful or withdrawn, the data will generally be deleted without undue delay from the end of the relevant recruitment process.
- For future opportunities / talent pool purposes, your data will be processed for an additional 12 months if you give your separate consent
Your rights
You may be entitled to:
- request access, rectification, erasure, restriction, objection, withdrawal of consent and data portability from BYD; and
- lodge a complaint with the competent supervisory authority.

This Privacy Notice explains how BYD Group companies in the European Economic Area and the United Kingdom (“BYD”, “we”, “us”) process personal data in connection with recruitment activities carried out through the Teamtailor platform (the “Platform”).
This Privacy Notice applies only to the recruitment stage, namely from the point at which you submit your application or otherwise enter into the recruitment process through the Platform, until the point at which:
(i) your application is rejected;
(ii) you are withdrawn from the recruitment process; or
(iii) you proceed into the hiring / onboarding stage.
If you are hired, the processing of your personal data during the later onboarding and employment stages will be governed by the separate employee privacy notice made available to you by the relevant BYD entity.
1. CONTROLLER AND CONTACT DETAILS
The relevant BYD entity identified in Appendix 1 for the position you apply for is the controller of your personal data for the purposes described in this Privacy Notice. If you have any questions regarding this Privacy Notice or the processing of your personal data, you may reach us at the contact details provided also in Appendix 1 below.
The Teamtailor Platform is used by BYD to support and manage recruitment activities. In this context, Teamtailor generally acts as a processor / service provider on behalf of the relevant BYD entity.
2. WHAT PERSONAL DATA DO WE PROCESS?
In the course of the recruitment process, we may process the following categories of personal data about you:
· identification and contact data, such as your name, address, telephone number, email address, place of birth and date of birth;
· application and professional profile data, such as your CV, work experience, previous employers, qualifications, education, professional background, skills, language knowledge and other information relevant to the position;
· recruitment process data, such as notes from screening, interview feedback, correspondence with you, application status and hiring decisions;
· compensation-related data voluntarily provided by you, such as salary expectations and current or previous salary information where relevant;
· information contained in documents or materials submitted by you during the recruitment process, such as cover letters, reference letters or other supporting documents;
· publicly available professional information, where relevant to assess your application, for example information made available by you on professional networking platforms or other public professional sources;
· referral-related data, where you are referred by an existing employee; and
· in limited cases, health-related information or other special category data voluntarily disclosed by you during recruitment, for example information relating to reduced working capacity or workplace accommodation needs.
Please do not submit personal data that is not relevant to the recruitment process.
3. HOW DO WE COLLECT YOUR PERSONAL DATA?
We may collect your personal data:
· directly from you when you submit an application through the Platform or otherwise communicate with us in the recruitment process; from documents and information uploaded by you to the Platform; from interviews, calls, written communications and other interactions with you;
· from publicly available professional sources, where relevant to assess your application;
· from employee referrals, where an existing employee refers you for potential consideration; and
· from recruitment-related service providers supporting the process.
Where we do not collect your personal data directly from you, we will process such data only to the extent relevant for the recruitment process and, where required by law, provide you with the necessary privacy information within the applicable timeframe.
4. FOR WHAT PURPOSES DO WE PROCESS YOUR PERSONAL DATA?
We process your personal data for the following recruitment-related purposes:
· to receive, register and review your application;
· to assess your suitability for the role you applied for;
· to manage and document the recruitment process, including screening, interviews, evaluations and internal approvals;
· to communicate with you regarding your application and the recruitment process;
· to consider you for another relevant open position, where appropriate and where you agree;
· to maintain recruitment records within the Teamtailor platform and related internal recruitment administration; and
· to share your application data within the BYD group where this is necessary for group-level HR administration and recruitment support.
This Privacy Notice applies only to the recruitment phase. If you are selected for hire and proceed further, the processing of your personal data for onboarding and employment purposes will be governed by a separate privacy notice.
5. WHAT IS THE LEGAL BASIS FOR PROCESSING?
BYD processes your personal data for the recruitment activities described in this Privacy Notice on the basis of your consent.
By submitting your application through the Teamtailor platform, and by providing your personal data in connection with the recruitment process, you consent to BYD processing your personal data for the purpose of handling your application and managing the relevant recruitment process.
Where your personal data is shared within the BYD group for group-level HR administration or recruitment support purposes, such intra-group sharing is based on the legitimate interests of BYD in ensuring an efficient, coordinated and properly administered recruitment process across the group.
6. IS PROVIDING YOUR PERSONAL DATA MANDATORY?
Providing your personal data is voluntary. However, if you do not provide the personal data necessary for the recruitment process, or if you withdraw your consent, BYD may be unable to consider your application or continue the recruitment process.
7. WHO MAY ACCESS YOUR PERSONAL DATA?
Your personal data may be accessed on a need-to-know basis by:
· relevant HR personnel involved in the recruitment process;
· hiring managers and interviewers involved in assessing your application;
· other relevant internal stakeholders where their involvement is necessary for the recruitment decision;
· BYD group entities providing group-level HR administration, recruitment support or related services, where necessary and appropriate; and
· Teamtailor and other service providers supporting the recruitment process, acting under appropriate contractual arrangements.
8. INTERNATIONAL TRANSFERS
Your personal data may be accessed from, or transferred to, recipients within the EEA, the UK, or, where relevant, outside those territories. Where personal data is transferred outside the EEA or the UK, BYD will ensure that appropriate safeguards are in place in accordance with applicable data protection laws in a form of a proper Transfer Arrangement based on proper standard contractual clauses. You may request further information on the applicable safeguards using the contact details set out in this Privacy Notice.
9. HOW LONG DO WE KEEP YOUR PERSONAL DATA?
We retain your personal data only for as long as necessary for the purposes set out in this Privacy Notice and in accordance with applicable law and internal retention rules.
In principle:
· If you are hired: your recruitment data may be transferred into your employment record and retained in accordance with the employee privacy notice and the applicable retention periods for employee data.
· If you are not hired: your personal data will be deleted immediately from the end of the relevant recruitment process, unless a longer retention period is required or justified under applicable law, for example for the establishment, exercise or defence of legal claims.
· If you are considered for future opportunities / talent pool purposes: in case of you specifically authorize this, your personal data will be retained for an additional 12 months, after which it will be deleted or anonymized unless a further lawful basis for retention applies.
Certain limited records, such as your name, the position applied for, and the outcome of the application, may be retained for the applicable local statutory limitation period or other relevant claim period, but in any event for no longer than 3 years from the end of the relevant recruitment process, unless a longer retention period is expressly required by applicable local law. Such retention applies only where necessary for recruitment governance, audit trail, the establishment, exercise or defence of legal claims, or internal reporting purposes. Any internal reporting will, where possible, be prepared on an aggregated or anonymized basis.
10. AUTOMATED DECISION-MAKING
BYD does not use solely automated decision-making, including profiling within the meaning of applicable data protection law, to make recruitment decisions about applicants.
If this changes for a particular recruitment process, appropriate information will be provided to you in accordance with applicable law.
11. YOUR RIGHTS
Subject to the conditions and limitations set out in applicable law, you may have the right to:
· request access to your personal data;
· request rectification of inaccurate or incomplete personal data;
· request erasure of your personal data;
· request restriction of processing;
· object to processing carried out on the basis of legitimate interests;
· withdraw your consent at any time, where processing is based on consent, without affecting the lawfulness of processing carried out before withdrawal; and
· where applicable, request portability of personal data processed by automated means on the basis of consent or contract.

12. RIGHT TO LODGE A COMPLAINT
If you believe that the processing of your personal data infringes applicable data protection law, you have the right to lodge a complaint with the competent supervisory authority in the country of your habitual residence, place of work, or place of the alleged infringements. You may also contact us first, and we will seek to address your concerns.
13. DATA SECURITY
BYD and Teamtailor, as the provider of the Platform takes appropriate technical and organizational measures to protect your personal data against unauthorized access, loss, alteration, disclosure or misuse. Access to applicant data is restricted to those who need it for recruitment-related purposes, and recruitment data is handled in accordance with BYD’ internal security and confidentiality requirements.
14. COOKIES AND PLATFORM-RELATED INFORMATION
The Teamtailor platform and related recruitment pages may use cookies or similar technologies. Where cookies process personal data, such processing is governed by the applicable cookie information or cookie notice presented on the relevant site or platform.
15. CHANGES TO THIS PRIVACY NOTICE
BYD may update this Privacy Notice from time to time in order to reflect changes in legal requirements, recruitment practices or the use of the Platform. The most recent version will be made available through the Platform.
